, uses of land were introduced, and though totally discountenanced by the Courts of common law, were considered as fiduciary deposits and binding in conscience by the clergy, the separate jurisdiction of the Chancery as a Court of equity began to be established ; and John Waltham, who was bishop of Salisbury and Chancellor to King Richard Ir, by a strained interpretation of the above Statute of Westminster the Second, devised the writ of subpoena returnable in the Court of Chancery only, to make the feoffee to uses accountable to his cestui-que me; which process was afterwards extended to other matters wholly determinable at common law, upon false and fictitious suggestions. In the reigns of Henry iv and , the Commons were repeatedly urgent to have tin- writ of 8ubposna entirely suppressed, as being a novelty devised by the Bllbtilty of Chancellor Waltham, against the form of the common law. So far from being suppressed, the writ of subpoena manifested various developments, and was utilised by the Courts of common law, as well as 1 v the Court of Chancery, to serve various purposes.

The original subpoena aid respondendum was adopted by the Court of Exchequer; the subpoena ad testificandum, and subpoena duces tecum became the ordinary processes for summoning witnesses in all the Courts of common law; and even the subpoena to pay costs was made use of in actions of ejectment. The other forms, viz. the subpoena to hear judgment, and to name a solicitor, and to show cause, were confined to the Court of Chancery.

This writ was issued by the Court ol Chancery immediately after the filing of the bill of complaint, and com- manded the defendant within eight days after service, laying all other matters and excuses aside, to cause an appearance to be entered to the liill, upon pain of an attachment or such other process of contempt as tin- Court should award. This writ was abolished in 1852 by 15 16 Vict C 86, s 2, and in its place an indorsement was prescribed to be made upon the bill of complaint calling upon the defendants to appeal to It The penal clause was subsequently altered by order of the Court (Consolidated Orders, Order 9, 2), and, as amended, informed the defendant that if In- failed to appear the plaintiff might enter an appearance for him, and he would be liable to be arrested and imprisoned, and to have a decree made against him in his absence.

In the Exchequer of Pleas the subpoena ad respondendum commanded the defendant bo appeal before the barons of the Exchequer to answer the king on a penalty of £100 Notwithstanding the money penalty, the prac- tice was to attach the defendant for disobedience of the sub])oena.
